Binding Financial Agreements

We assist clients with drafting, reviewing and negotiating binding financial agreements where parties have reached agreement on terms, whether entering a new relationship or formalising a financial separation.

Binding financial agreements can be entered into at different stages of a relationship, including:

  • before a relationship or marriage (pre-nuptial agreements);

  • during a relationship; and

  • after separation or divorce (to finalise property and financial arrangements).

It is critical that these agreements are properly drafted and comply with the strict legal requirements under the Family Law Act 1975 (Cth) to ensure they are legally binding and enforceable. Each party must receive independent legal advice, and the agreement must accurately reflect the parties’ intentions and financial positions.

We provide clear, practical advice and prepare agreements that are comprehensive, properly structured and tailored to your circumstances, with a focus on protecting your financial position and minimising the risk of future disputes.

We also assist with reviewing and advising on agreements prepared by other parties, ensuring your interests are protected before signing.

We offer fixed fees for certainty and transparency.
